That’s right! This just happened this afternoon. A Federal Appeals Court in California declared same-sex marriage ban unconstitutional. The U.S. Circuit Court of Appeals with a three-judge panel ruled 2-1 that a lower court judge correctly interpreted the U.S. Constitution when he declared in 2010 that Proposition 8 was a violation of the civil rights of gays and lesbians.

“Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples,” said Judge Stephen Reinhardt in the majority opinion. “The Constitution simply does not allow for ‘laws of this sort’.”

I bet Renato Corona cannot write that kind of decision!

And I wonder if the Supreme Court in the Philippines could even come close to this decision. Since there is a judge there who is fond of copying decisions, maybe he could just copy this one.

“Although the Constitution permits communities to enact most laws they believe to be desirable, it requires that there be at least a legitimate reason for the passage of a law that treats different classes of people differently. There was no such reason that Proposition 8 could have been enacted,” the ruling stated.

Ain’t that sweet?

I remember the TRO decisions written by the justices of the Supreme Court in the Philippines! Only Judge Sereno wrote a very, very well written decision. The rest? Plain shallow. They could have just hired a high school drop out to write the decision for them.

I really love my car. Feel ko rich an lola nyo even when I just got back from a cheap lunch at Wal-Mart.

It’s excellent for long drives. It has a very smooth and silent drive. This car has trekked all the way up to Montreal, Canada; Boston and Provincetown, down New Orleans and now, whizzing Charleston and Philadelphia. Except for its gas consumption and fancy maintenance expenses, no complaints.

It’s a 2004 model, nearing 8 years. That’s your lola. Pramis, very loyal ako hehe! When I say I love you, todas ka, akin ka na forever. Hindi ako nagpapalit nang boylet. In fact, kahit fones, magunaw na lang ang mundo, if my fone can still send and receive pocketbell messages, happy ang lola. Ask my ceremonial girlfriend, Malen.

So, Triple X Car company is probably annoyed to the bones at seeing my car every now and then for some fancy maintenance. I can only imagine… at the sight of my car, they must be frantically dialing some tow company to move my car which is probably the most visible outlier they have on their parking lot. Ruins the view.

So they called. Just now. A few seconds ago. He said his name is Jeff. He was asking if I am interested in trading my old car. A-WHAT?!@#$%^! HE CALLED MY CAR AN OLD CARRRR???? SIMBERGUENZA!!! HOW DISRESPECTFUL!!! GRR!

I asked him why would I trade my car?! He said because there is somebody looking for this particular model and they don’t have this on their lot, so they called me. I was still talking and explaining something then he quickly said… “Ok, thank you!”
AMFFUTTTA!!!~!@#$%^&*()

And whodahell is that somebody interested with my car?! DONALD TRUMP?! Get away from me! Hmpt!

Ok.

Let’s play some logic and reasoning here for a minute.

So somebody wants my old car. And that somebody believes that my old car is valuable, very, very valuable; otherwise, he would have no interest at all. Nada. Zip. Ziiiiit.

In fact, my old car is so valuable that Triple X Car company will have to search the entire United States and single-handedly pick me for I have the most valuable car in the world.

Before I watch the video presentation of the Logically Absurds (the Defense, the Prosecution, Joker Arroyo and a host of other senator-fudges hahaha!), let me summarize what transpired on Day 10.

Listen and watch Pia Cayetano 1:28:00 who mentioned that she’s got clients who’s doing business even with licenses and permits revoked! Arrghh! I was scratching my head! And the Lady Senator allowed that?! Businesses whose permit to operate, license to operate were revoked but are still conducting business?! Anovey talaga?! Di ba that is illegal na?! Anak nang fatula uu!

So basically, the learning curve on Day 10 is this…

If my CPA license is revoked, I can still practice, I’m still allowed. So yon, to conduct an illegal business is legal.

Yehey!!! Hahaha!!!

Didn’t you all notice that during the first few days of the impeachment trial, everybody describes the defense panel as one of the brightest legal mind there is? Who would not describe them as such? Look at their credentials!

Now, today, an official of Megaworld Corp. testified that the company gave a P10-million “reduction” to Chief Justice Renato Corona for a “water damaged” P14.5-million condominium unit in Taguig City.

P10 MILLION PRICE REDUCTION on a P24 MILLION CONDO UNIT.

Who gets that obscene amount of discount?!

Where are the brightest legal minds on this?! What do they have to say?!

THIS IS ABSURD! YOUR HONOR! DEZ EZ ABZZZAARDDD!!!

Alam nyo. Gusto ko nang tunawin ang corona ko. Malapit ko nang sumpitin ang… Hmpt!

Palace pressuring me to quit – Cuevas

Cuevas said he had been approached on a number of occasions by a lawyer to deliver a supposed message from Malacañang.

He said he was being asked to leave the defense panel in exchange for the withdrawal of the criminal case against Magtanggol Gatdula, the recently sacked director of the National Bureau of Investigation.

“I was told that the President wanted me out as a bargaining chip in the case, that they would no longer pursue it provided that I withdraw,” the counsel said in Filipino in an interview with the Inquirer in his Makati City office on Saturday night.

Cuevas is also the legal counsel of the influential Iglesia ni Cristo (INC), of which Gatdula is also a member. Gatdula has been implicated in the alleged kidnapping of an undocumented Japanese woman.

Cuevas identified the emissary, supposedly a member of Malacañang’s “rah-rah” boys, but asked that his name be withheld. He said the man, his former student at the University of the Philippines’ College of Law, feared Palace repercussions.

“I know him to be with Malacañang, (but) I’m not sure whether he’s authorized or he is doing it himself,” the defense counsel said. “I don’t speak with the President anyway … I do not want to add credence to that.”

It’s not Malacanang. I have to admit. I am doing my best and really pressuring Cuevas to quit.

With no offense intended to the Secret Hairless Society, Cuevas hair is a total culpable violation of the constitution!

Weird, but this is what I’m reading from one of President Noynoy’s political adviser latest snafu, punishing the buyer instead of the seller, distributor and maker of pirated products.

But first…

I took these pictures in Dampa along Roxas Blvd where you will find this:

Of course, you’ll find dozens of places in Manila selling pirated products. The mecca, I believe, is Quiapo.

Now, is there something wrong with this news? Or is it the effect of the cold medicine I’m taking?!

All of us are aware of the anti-piracy law, maybe not the details but it’s clear that we cannot buy or sell pirated DVD’s, software, digital music, etc. and make money of someone else’s invention, work, production and perspiration.

Now that I have laid out the basics, here is a disturbing news that is not reconciling to me.

According to this news I’m reading, PNoy’s political adviser was photographed apparently purchasing pirated DVDs. That created a heatwave and it reached Malacanang that an investigation was conducted. He even apologized to the President. His name? Ronald Malas. Opps. Llamas. The same guy caught with an unlicensed high-powered assault rifle inside his car which had figured in a road accident.

Now, let’s push this high-powered assault rifle on the side muna.
Let’s talk about this Ow My Bad muna. (OMB)

I’m not defending Llamas here. Panget sya.

But here’s what’s not reconciling.

So it’s ok for these stores to sell pirated wares, but not ok to buy them?!

Somebody please explain this to me like a five year old kid.

THE TRUTH, AND NOTHING BUT

The Impeachment Court is in a class of its own.

Quoting Senator Juror Miriam Defensor-Santiago, the Impeachment Proceedings is both a Political and Judicial Process in a “quasi” form. In her own words, “quasi” is defined as “like, but not exactly”.

Only a handful of officials, the most powerful in the country, can be removed from office only through impeachment, namely, the President, the Vice President, Supreme Court Justices and the appointive officers of Constitutional Agencies.

In this regard, not one set of rules prevail (criminal, civil, administrative or even political). All the rules become suppletory in order to protect both the right of the accused and the right of the accuser to prove their case while ensuring a reasonable decent adherence to procedure by both defense and prosecution.

The Senate, when convened as an Impeachment Court retains exclusive jurisdiction on all matters pertaining to the Impeachment Proceedings.

The members of the Senate Impeachment Tribunal and the Prosecutors were not elected because they are lawyers even if some of them actually are. Even those who are lawyers may not be expected to be active practitioners or litigators much like those in the Defense who must necessarily be in the private legal practice. As such, they are not trained to think, speak and behave like lawyers and neither must they be expected to think and act like one.

The members of the Senate and the House are elected because they are the chosen representatives and the repository of the people’s trust and confidence. As such, they only have their best judgment and wisdom to guide them in their current role as the Impeachment Tribunal Jurists and as House Prosecutors.

The House has no choice under the Constitution but to choose from among themselves who must be Prosecutors. Except where allowed by the Tribunal to use the services of private prosecutors only in the presentation of evidence or testimony, the House Prosecutors must themselves prosecute.

By contrast, the Defense has all the freedom to choose whoever they wish from among the best private practitioners in the legal community.

The Impeachment Court is the repository of public trust, in that, as much as the public is immensely involved in this, it is the wisdom of the Prosecutors (Congressmen) and the Jurors (Senators) where the public entrusts its will. They are, after all, representatives of the people.

Today’s events led to more educational perspectives raised by Senator Defensor-Santiago, by way of asking, which Required Level of Proof should be used by the Impeachment Court. There are several used in Civil, Criminal and Administrative Court Proceedings:

Substantial Evidence
Preponderance of Evidences
Clear and Convincing Evidence
Proof Beyond Reasonable Doubt

The Impeachment Court is allowed by the Constitution to be liberal in crafting and applying rules in the course of the trial.

Both sides (defense and prosecution) are also allowed to argue their point and ask the Presiding Officer to make a ruling. And unless a juror disagrees with the ruling of the Presiding Officer, in which case, it must now be put to a formal vote, the ruling stands. The Court even has the option of going into a caucus (closed door; in their chambers) to decide an issue without putting the issue to a formal vote in open session.

Another unique aspect would be that although both the prosecutors and defense are subject to certain rules governing court procedure (e.g., leading or misleading question, best evidence or hearsay rule, etc.,) any Senator Juror is allowed to ask questions of any nature to further clarify a point and/or to speed up the process.

The uniqueness of the Impeachment Trial has caused much confusion because of the quasi-judicial-political nature of the proceedings, at the same time, each begging for strict and liberal guiding principles and rules of procedure.

So, how shall the twain really meet?

This is where the so-called trust and wisdom in the elected representatives come into play.

This is the wisdom of the Prosecution (congressmen) to present their arguable case within the rules primarily prescribed by the Constitution, and the wisdom of the Impeachment Court (senators) to govern the impeachment trial where the best interest of the people is upheld and protected.

Now we know that when we cast our vote, we are not simply voting in our locality for our localized interests. We are voting to keep our country together when an event, such as an Impeachment, happens within their elective term.

When we vote, we are entrusting these men and women with our history and how the whole world views us. History cannot remember each one of us. The world cannot see our individual deeds borne out of our individual values and principles. And having been elected, they become the BEARERS of our trust and the REPRESENTATIVES of our collective wisdom.

This Impeachment goes beyond Chief Justice Renato Corona. This Impeachment will live on long after the earth has had its way with all of us who are now glued on our tv sets to witness these proceedings.

2013 is just around the corner. Let us learn and see beyond the names, faces and ability to dance or declaim of those who want our TRUST.

It has been said that when we vote, we entrust them with our lives. I say, when we vote, we entrust them with our destiny as a nation, not just for today or for the next generation.

History will judge us by the choices we make in the people we elect to positions of trust.

For the matter at hand, this is a quest beyond any rule or procedure.

This is plainly the people’s search for truth and nothing but.
