Annuncio mga kabisyo!

Soon, I will be the first woman President of the Philippines. But we have a lot of problems and issues at home mga kabisyo kaya May I Wait na lang ako na ma-resolve lahat nang problema para wala na akong gagawin kundi mag-santacruzan sa Mendiola. Kaya naman I don’t envy those select politicians who are in their positions who are there to really serve the best interest of Filipinos in the Philippines and all over the world. (Teka, meron nga ba? Paki-check nga uli!)

Mag-pugay po tayong lahat ki Empress Maruja who shared us the link of the latest internet enchilada dala nang circular by the Philippine Overseas Employment Administration.

What is this circular about? Let me summarize the circular in a blitzkrieg way: POEA is now the only and only recruitment agency in the Philippines. Period. Getz nyu?!


Why? There are no more direct hires mga kabisyo. Kafuuut. Piniz. That’s it. End. Kaya any foreign employer wishing to hire a talented and good looking Filipino stud worker like or professional call center diva like Malen, shall now go directly to POEA, pre-qualify, get an approval and do the samba.

So, before you all rise up in arms mag-deodorant muna kayo at wag magpapotok nang watosi. Rather, let’s try to understand muna the why. Ba’t naging bipolar ang POEA? Ba’t ba nagkaron nang multiple personality ang POEA at nag-decide na maging DOLE at OWWA taz naging very strict with the hiring of Filipino workers going overseas? Me labor shortage na ba sa Pilipinas? Baaaa!!! Malay ko! Hmpt!

Pero, there are a lot of possible answers mga kabisyo. I’m sure, mga matatalino ang mga policy makers na to and they must have thought of this policy from deep down their magical brains sa singit nila. Kaya, let’s just give them the benefit of the doubt noh? Besides, kahit hate ninyo ang POEA, honestly, medyo marami naman silang natulungan divanetch? I’m sure panatang makabayan sila ever at qualified sa posisyon nila. Although me mga iba kasi tayong mga kasamahan na medyo matitigas din ang ulo. Kasi, it’s possible that they’re (POEA) trying to:

1. Protect Overseas Filipino Workers who fall prey on fly-by-night recruiters, fake employment agencies who promised jobs in Dubai but landed you in Mindanao, fake employers and all the devils in the world that are just out to use Filipinos for material and sexual needs.

2. Stem the tide, reduced or stop the deployment of Filipinos overseas because of brain drain that OFW migration has done to the country. Now, why they don’t ship all the kurakots in politics to Siberia, ewan ko ba!

3. Although malayong mangyari to, but this would reduce also OFW remittances, bawas ang mga dolyar na lumilipad sa kalsada nang Pilipinas at baka bumalik ang piso sa palitang isang balde.

In ferness, maganda naman pala ang layunin nila because this is actually good especially dun sa mga ina-abusong mga OFW. But think about this mga kabisyo. Obvious na obvious na me side-effects ang gamut na to nang POEA. Dahil posibleng:

1. Dahil sa mataray na regulation, it will be tough for new recruitment agencies to enter this market especially if you don’t have enough capital. Kaya mukhang this policy eh proteksyon sa mga mayayaman or proteksyon sa mga well-established recruitment agencies.

2.They’re making it difficult to hire Pinoy talents because madaming notaryo publikong kelangang maglaba nang mga dokumento bago ka makahire nang worker. Mawawalan sila nang gana. Titingin sa iba. Mag-ha-hire nang Vietnamese, Chinese, Malaysian o Indonesian o Pekeng Merkanong gaya ko.

3. Mas lalo kamong mahihirapang maghanap ang mga pobrecitong Pinoy na indi kaya yong placement fee na tinataga sa kanila nang mga balasubas dyan.

4. Kung double-digit ang unemployment nang Pinas, magiging quadruplets na sya.

5. At dahil mahihirapan nang lumabas ang mga to, alam nyo ba kung ano ang babalik? Sirit? Sirit? Bakit kaya naiisip kong darami ang mga mail-order brides dahil sa mataray na regulations na to?

Alam nyo mga kabisyo… Ang nalaman kung pangaral ni Aling Bizing is that:

In problem resolution, the first step is to identify and understand the problem. You must segregate and separate each problem before you can come up with an effective resolution.

My personal position on this is this: I am not in favor of continued deployment of Filipinos overseas kasi I want to see Pinoy talents used to make Pinas great. Pero, I am torn because there aren’t enough job opportunities at home. Kung meron man, ang sweldo is plus minus one peso below poverty level.

However, I want to see those people in positions to help and assist OFW’s to learn savings, investments, entrepreneurial skills or otherwise provide technical help & venture capital. I honestly believe that this formula will work to stem the tide.

By seriously making it difficult for Filipinos to find work outside of the Philippines and by making it difficult for prospective employers to hire Pinoys, defeats the very purpose of the policy.

Which brings me to my Miss Universe question:

Exactly, what is the problem that you’re trying to solve POEA?

    Pang Miss U nga ang tanong mo.

    This is news to me indeed! Though I am not a fan of the current brain drain that’s going on in the Philippines, and the tens of thousands of Filipinos who get duped to work outside the Philippines who end up with fake work contracts, I still think this is such an extreme measure to put in place to ‘protect’ aspiring OFW.

    I smell something fishy!

    hindi naman sa dahil mga overseas pinoys tayo eh pero i agree with you. nag-evolve na ang pangalan nang pinoy where can you remember nung mga OCW pa ang tawag? Taz domestic helper? I mean, me mga domestic helper pa rin, pero iba na ang perception saten pag sinabing OFW parang nawala na yong stigma.

    but of course, tayong lahat naman ang nagpaganda nang pangalan na yan di ba?

    kaya, pasok na sa kwarto roni, i padlak na ang bahay at tumigil na nang hada! hahahaha!!!

    Yap pahirap yong circular na yan, pero latest info yata, eh suspended daw yong memo as for the moment, di ko lang alam until when hehe,mukhang pag-uusapan daw ng kanilang mga Board of Direksyon hehe, dito sa Singapore, nag karon kami ng online petition, mukhang natinag yong mga tiga POEA, biruin mo naman,papayagan kang ma hire sa Singapore, as long as yong prospective Employer mo sa Singapore will pay S$5,000.00 sa POEA (hmmmm I think something fishy2x )or something like that kinda an insurance policy, basta2x,to explain further hehe, eh sino ba namang Employer mo ang magbabayad pa ng bukod sa POEA,not unless siguro kakaibang talent mo , as in bumubuga at kumakain ka ng apoy habang nag program sa Java hehe.

    Ang epekto nito kasi in case totally implement na talaga. Kahit na 7 years ka pang nag work sa Singapore and need you na mag renew ng OWWA membership, hindi ka nila i-aaprove kasi, yon nga,need muna dumaan sa screening ng POEA yong employer mo, pag hindi sila naka comply with the new POEA circular,ika nga ni Reynz, tyugi na ang pangarap mo. So ikaw maiipit ka, either tuloy mo yong work mo,sa Singapore, pero hindi ka member ng OWWA, so ala kang insurance as an OFW. Ibang klase nga eh, mas mahigpit pa yong Pinas kesa sa Singapore, o san ka pa.

    Iba naman, ang solution (just like me hehe) mag apply ng PR (Permanent Residence) as for the moment. Kaya ayun,dagsa ng pinoy sa pilahan ng nag-aaply ng PR dahil sa Memo Circular na ito.

    Kaso ang advantage kasi ng member ka ng OWWA lalo sa amin dito sa Singapore na madalas mauwi, ay nakakakuha ka ng OEC pass, yong OEC is para pag babalik ka na ng Singapore ay you don’t need to pay Travel Tax P 1,500 at Travel Fee di ko sure kung 250 or 400 na yata ngayon, and pag kasama mo wifey, or mga anakis mo (kunwari papasyal or isasama mo sa Singapore), ang Travel Tax nila ay P 500 na lang, since relative sila ng isang OFW at dapat OWWA member ka. Basta dapat may dala ka lang na NSO certified Marriage and Birth Certificate.

    (o puede na ba akong extension office ng POEA at OWWA hehe)

    By the way sa mga tiga Singapore or papasyal ng Singapore, may promo ang Jet Star ng mga Flights from July to October this year, kasama ko dito nakapag pa Book S$127.00 or in peso ay P 3,690.00++ lang (balikan na yon ha) Manila-Singapore Singapore-Manila na. Hindi ko lang until when hehe, pero may Booking period lang ito sigurado.

    in the end, dahil wala namang makakapigil sa mga pinoy sa pagtatrabaho nila sa labas ng bansa, mas pipiliin nila ang risk na wag mam-member ng POEA and similar chuvas. di ba naisip ng mga tagapanukala ng batas yon?

    tama yung sinabi ni reynz, hindi sila marunong sa root cause analysis. kailangan nilang matutunan ang FMEA at Six Sigma Methodologies. Hahaha!

    I don’t know kung nagtatanga-tangahan ang gobyerno sa ura uradang pagpapatupad na mga batas tulad nito. Alarming to sa mga OFW. Tama nga yung sinabi ni Madam Sinaglaya, pag ayaw na nilang irenew ang contract ganun na lang ba kasimple un? Hala mapapakain ba nila ang mga naghihirap na pamilya ng mga kababayan nating OFW dito sa Pinas? di ko alam kung ito’y isang simpleng kurakot o kurakot talaga.     $5,000 Ambo PER and singil nila. Ti-play ti-play mo yan. Sino kaya sa mga yan ang nag-calculate nya. Eh yong sa OWWA lang kano din yun $25 taz pinag dakdakan sa mundo na tipid na daw dahil tumaas yong value nang piso! hmpt! nakuuu!!!

    teka lang ambo, alam mo, pede mong gamitin yong ginagawa nang mga cleaners dito gaya sa bahay nang kebigan kong si chuva, nag-hahire sya nang cleaners in the nude maglinis. heheheh!

    I want to clear yong regarding don sa S$5,000 , I think it’s not really a direct payment, but kinda parang BOND ng employer mo sa POEA, I think as in a sort of Insurance or something in that kind ba.Maybe we have to further investigate and research pa regarding sa POEA Memo circular 04 so we can really acquire real facts, in fairness naman sa kanila. Though sabi nga nila,mahirap naman basta2x nag conclude or just listen to myths regarding this issue but however hindi naman magagalit majority ng mga OFW or those who are planning to work abroad kung ang dating nong Memo Circular 04 na yan ay kinda pabor sa taong-bayan. Though POEA said they just want to protect yong mga na abuse na or nalolokong mga OFW abroad, kaya lang siguro may something in that Memo na siguro need nilang i-fine-tune or look the other way around which may really be benefit the madlang taong-masa hehe. Or minsan kasi yong pag kakagawa nong Memo ay may baka may konting agenda behind hehe, Siguro maganda madinig natin at ma share ang opinion ng mga mismong HR practitioner na Blogger, I think they are mostly updated when it comes sa mga ganitong issues lalo na when it is connected sa mga labor issues or concerns : ).

    i think you’re right - kasi nung binabasa ko yong circular (as in may i read many times pa nga) ang feeling ko eh instant na nang-galaiti ako, it’s not written FOR the OFW’s rather ang tono talaga eh pang-aroganteng POEA although sinasabi nila na they are protecting OFW pero hirap basahin sa circular kaya an labo kung sino talagang pino-protetahan nila dahil para saken obvious na yong mayayaman at mga dating established na mga recruitment agencies.

    andun na ako, dami talagang mandurugas na agencies at mga gagong foreign employers, pero indi ang circular na to ang makakalutas nyan! asan yong foreign affairs to foreign affairs or govt to govt chuvalais na dapat palakasin nila instead na aapear na lang sila pag chinu-chugi na ang OFW? wala di ba? puro na lang photo opp at electioneering ang nangyayari

    tong POEA naman, di ko na maintindihan kung ano ba talaga ang role nila sa mundo, naglalabo labo na ang mga responsibilities nila nang DOLE, OWWA, Immigration, Dept of Justice, BIR at collection agencies.

    madami kasi talagang problema pero di mo sya masosolve nang isang arangkadang circular na feel nila kayang isolve lahat nang problema nang OFW taz lumalabas na parang SINO nga ba ang tinutulungan nila?

    Reynz, since the late 80’s pa itong mga local problem na hindi maresolbahan ng POEA natin. Totoo ang sinabi mo, walang ibang choice marami sa atin kundi subukan makipagsapalaran sa labas ng bansa, kaso mo bago pa man makalabas ay ibabaon na sa utang ng mga recruiters and yes, even POEA itself.

    kaya kung ako sa mga kababayan natin na dumadaan sa parusa ng POEA, may I raise ko armpits ko na hindi pinaliguan ng isang linggo, hmpft! At tatambay ako magdamag sa lahat ng palapag sa POEA.

    The implementation of the memo circular # 4 is held in abeyance only in Singapore.

    The amount of 8,000 is for performance bond at 3,000 and 5,000
    for repatriation bond.

    A performance bond is a financial tool used to guarantee that in the event of a the employer’s default,

    A repatriation bond is a document guaranteeing passage of an individual to a specified location upon completion of contract work or upon suspension of contract work for any reason. Mostly it is the latter.

    Since these are bonds, the people who are supposed to pay that would not necessarily shell out $ 8,000.

    For a performance bond, only 10 per cent is paid as a premium.

    I do not know about repatriation bond. Given that it is also 10 per cent, the total cash outlay is $ 800.00 only. The whole 8,000 will be forfeited in case they renege in the contract.

    So I do not think that contract renewal will necessitate another posting of bonds. It is just my opinion.

    As an OFW, I remember that I paid for some insurance to the DOLE via agency. But this is only for travel and nothing for the protection from employer’s change of mind.

    The issue here is that even with the indirect hiring, the OFWs are not protected from unscrupulous employers which changed the term of the contract once the employees have started working. This is mostly in Middle East countries.

    So, the POEA has to identify which among the countries hiring OFWs need the implementation of this memo.

    I like the last sentence that you said, they have to identify which countries are the worst offenders to OFW’s and BTW thanks for that explanation. I was surprised, sa Singapore lang eto not fully implemented. I seem to think that they lumped together all the problems in one bowl and thought that all the countries are the same as far as notoriety in treatment of OFW’s. I’m sure there must be countries out there who are not as bad as the ones in the Middle East and I’m not sure why the by country to country basis would not work.

    But even with the performance bond, if the total cash outlay is $800 PER person, there’s still the possibility for the employer to renege on the contract, I mean, what with the $800 - that’s too small - is this how I read this?

    From what I understand (because I’m opening an agency and I actually have several resumes on my hand already), Pinoys can apply directly to employers abroad. Here’s the kicker - these are the very employers that this Circular is targeting. But am not sure (i have to call my lawyer this weekend and clarify this one)

    Performance and Repatriation bonds are just like insurance. You pay only the premium. Renege the contract and you pay the whole amount.

    So if the employer renege the contract the total amount of the policy will be enforced to the employer to be used for sending the contract worker back to the Philippines.

    Parang bail bond. It does not mean that if you’re bail is 150,000, you pay the entire amount of 150,000. You just pay the premium which could be 10 per cent. Jump the bail and the insurance and bonding the company will hunt you down with their bounty hunters to make you pay the whole amount.

    Besides, bonds are paid to insurance or bonding companies not direct to the POEA.

    It is some sort of escrow.

    I’ve got a friend who went to the Middle East and the employer terminated her because she did not accede to the sexual advances of the boss. The POEA made the employer shoulder the fare going home.

    For direct hire, the POEA can not do this because one, the contract will be between the employee and the employer.

    That was good C at. You think these bonds will work to really force would be employers to stick to the contract? I mean, what are the chances na pumalpak tong mga bonds? Base sa explanations mo, I am beginning to believe that POEA should focus on the Middle Eastern countries.

    The proceeds of the bond will be paid to the employee not the POEA.

    So i do not see how the POEA will make benefit out of it financially, except to discourage direct hiring to favor the recruitment agencies in their list.

    What’s confusing with the news which alarmed many OFWs is the amount of the bonds.

    There was no explanation whether that is a premium to be paid which i doubt or that is the amount of the bond itself.

    some people who do not understand how the bond works mistake it as a fee to be paid to the POEA.

    It is only enforced when the risk insured happens.

    The policy may serve as deterrent for employers to make direct hiring.

    whatever may be the result, the agency should be flexible in its implementation of new policies or regulations . if it is not effective, then it should be scrapped.

    i think the philippine government is the only one in the world which has its own employment agency- POEA. (imagine, sarili mong gobyerno ang agent mo?). anyway, this new circular is a way for POEA to reassert its role– that every juan and maria who wish to work abroad should recognise the veto power of POEA. in short, kailangan ka nyang pigain at pagkakitaan. yun lang.

    POEA doesn’t mean Philippine Overseas Employment Agency, it means Philippine Overseas Employment ADMINISTRATION.

    It regulates overseas deployment of labie thru the registered recruitment and employment agencies.

    Yes, reyna, in the US, it is the INS which issues quotas on working visas and their department of labor issuing labor accreditation are the agencies that oversees employment.

    there was also a time when employers who wish to get computer engineers from abroad have to pay $ 500 (this is not even a bond)
    to go to the fund which was earmarked for training and continuing education for those who would like to pursue career in IT.

    5,000 lang ba? e bakit 7,000 ang binayad ko :( ..daming pangako kapag umattend ka ng PDOS ng POEA nakakalula tuloy, pero kapag tapos na ang PDOS at may nangyaring hindi maganda sa mga OFW sa ibang bansa pahirapan…ang ganda diba?
