Here’s an email I received from one of my avid reader.
Mahal na Reyna,
A lot of Filipinos in the United States live a good life. Which is why, a lot of Filipinos may not be aware of this, but we have a growing number of Filipino immigrants who are deported back to the Philippines. You don’t hear this often, nor read it on the papers.
Which is why I would like to request if you would kindly publish my letter on your website. And with this, I hope to reach out to Filipinos, who currently have “OPEN COURT CASES†here in the United States, as well as their families who are facing deportation.
I am offering my unconditional support by providing assistance, help and advice to the extent of researching their case, to the extent possible.
My objective is nothing more that to inform them, that there is someone out here to help them, assist and/or advice them, should they be in this kind of situation.
I do this as a public service, in honor of my friend - a friend who’s agonizing moment of decision to leave his family will forever be etched in my heart and in my mind. Let me repeat, as a “public service†with no monetary fees whatsoever. (Well, you may click the Google Ads of Reyna and that’s about it!)
Let me share to you all, the story of my friend, who was deported back to the Philippines in May of 2005.
He was about 16 or 17 years old when he moved to the United States. He was adopted by his Aunt, who was an American Citizen.
Years passed, he got married, started a family and had a son. He moved to West Virginia. Everything was working out for him. He had a stable job and a wonderful family to go home every night.
One night, he and his friends went to a bar to hangout. Unfortunately, they got involved in brawl inside the bar. To make the story short, he was arrested and a case was filed against him.
Expectedly, a court date was set and the proceedings got started. His counsel advised him to plead guilty to Assault in the 4th degree, which is considered as misdemeanor in West Virginia. The counsel, meanwhile, had no knowledge that he had just advised his client to plea on something that is deportable, that is, a deportable plea in the revised amendment code of the Immigration and Naturalization Act (INA). With that plea, he was sentenced to one (1) year probation (no jail time). Unbeknown to my friend, his counsel gave him a wrongful advice.
While serving his one (1) year probation, he thought all along that it will be over soon and, that he could rebuild his life and move on. He would be proven wrong.
When the authorities ran a “sweep†of the database, which was right around his one year probation, he was immediately picked up by the immigration authorities.
He was then detained. Detained as in, he was basically thrown into jail while going through the process of deportation. He fought this case for 1 ½ years, with no fruitful outcome. Unfortunately, there was one other problem, although he was adopted by an American Citizen, the adoption papers were never processed properly to give him an American Citizenship. The INS denied him the citizenship.
Eventually he would give up fighting. He made an agonizing decision to go back to the Philippines, leave his family in the United States and build his own and separated life back in the Philippines.
I was moved into tears seeing my friend go through the agony of accepting the reality that he will be separated forever from his family -Â his beloved family.
I honestly don’t want to see this happen to anyone of my kababayan. So please, should you be in a situation like this, please do not completely leave your fate to your counsel - my very first advice, know what you’re stepping into before making any hard decision, especially when it involve the Law of other countries.
If you have questions, post it in here or email reynaelena@ofwcenter.com.
To my friend, if you happen to read this, I’m doing this service in your honor, for nothing can compare the pain you’ve gone through.
Lots of Luck Pare…..
Sincerely,
SpeakOutYourAFlip
