I completely disagree, I don’t feel pity for him, first of all he is proven that he force himself to this woman. A woman have a right to say “NO” even if during a “date” a woman made herself look available, that does not mean she wanted to have sex. People have choices and if she said “NO” it means NO. I actually commend the Judge for following the Law of the Philippines, whether American or not if you do something illegal you should pay for it. In situation like that here in the US, you think a Judge here in US would not do the same as the Judge in the Philippines? And “Yes” he should be confined in the Philippine Jail, why should he be given a special treatment just because he is an AMERICAN. If a Filipino have the same case here in the US do you think the Judges would grant him a custody to the Philippines Consulate…… NOT!!!

The foremost basis of our loyalty and sympathy is not our nationality or country of origin.. that’s going to boil down to prejudice and stereotyping. We must keep an open mind and keep looking for truth – the truth must prevail and so must justice. We are all entitled to our own beliefs and opinions but we must always be rational, logical, and open-minded as we form our personal views.
While Daniel was “proven” guilty in the lower court, meron pang court of appeals at supreme court na mas mataas – that verdict is not something written on a stone so to speak. It can be reversed and I believe it will be.
Should he serve the forty years sentence in Makati jail? NO! As to your question, do I think a judge in the US will put a Filipino or other foreigner in US jails if he committed a crime in the US? In some cases yes, but in most cases NO! Why should US citizens be supporting the incarceration expenses of an alien, anyway? On the contrary, what the US government does is process these criminals and deport them back to their countries of origin and blacklist them from coming back here EVER!
My opinion is that Judge Pozon did a very “politically motivated” decision to have a place in history, to please and appease the Filipino public. Nevertheless, I believe later on – in a more decent time, that decision will be reversed by the higher court which will make us all look more STUPID, thanks to Pozon! If Nicole’s claim was true- that she was being helplessly raped in the presence of the three other accused, why didn’t your admired judge Pozon pronounced them four guilty on the basis of our conspiracy law? CONSPIRACY: THE ACT OF ONE IS THE ACT OF ALL!
Drop the morality shit out of this case. Rape is a sexual assault, there’s nothing moral about that. But what’s so moral about going out with four servicemen and getting drunk to the point of being “too drunk” to resist rape, either??? I NEVER CONSIDERED NICOLE A WHORE BUT I WOULD NEVER CONVICT DANIEL AS A RAPIST EITHER… I believe it was a sexual escapade brought about by alcohol and the interplay of circumstances. These are two consenting adults and if one of them later regretted the decision – she has absolutely no right to pin the blame on the other, right?
Let’s reverse the situation: Here’s an american girl, drinking like a fish with four Filipino soldiers on detail far from home…Later on, one of the soldiers had sex with her. A few moments prior to the sexual act, though, the american girl said, no, I don’t wanna do it…but too bad…she was too drunk to even put empathy to her last minute decision. The Filipino soldier interpreted that as “playing coy or hard-to-get” and that she doesn’t really mean it. So then they did it. The next day, the american girl sued the four Filipino soldiers for rape. One of them was convicted and was sentenced to forty years in jail in a foreign land. If that soldier happens to be your brother, would you accept the decision as fair and just? Don’t you think the moral guardians of the Philippines would cry foul for a different reason??? Yes, you are absolutely right, we are as a matter of fact looking for the truth. But, the question is who is telling the right version? Would you believe a girl who was dropped off on the side of the road after as what you have described as “drinking binge” or a military guy who apparently took the whole situation as“Foreplay”.
Appeals Court is next, then Supreme Court, as a Filipino I know eventually the Lower Courts decision would be reversed as always. Judge Pozon as a matter of fact made a “political motivated” decision, but maybe, just maybe he also made the decision based on the evidence that is present during the trial. We would not know until the full transcript of the case is made available. In my opinion I think it is about time to make political statement. It may make us look “stupid” as what you have describe on what the end result maybe, but when is the right time for us to implement our Law in our own land without thinking in fear of what United States might say or do.
Why Smith should serve his sentence of 40 years in Makati Jail? He committed the crime in our country, that’s why! Where he is now, is where he is supposed to be. Apparently you are not aware of the whole judicial system here in the US. An Alien (legal or not) have to serve the sentence that is given by the Court Judge before he is put in the list to be deported. Maybe you should be aware that Filipino Citizen who is convicted of a crime in the United States must carry out the sentence before he gets to go back to the Philippines and be black listed to go back to the US. Please know your facts….
And if the Situation is reversed, I still think it is fair and just. Even if it was my brother…..
And please I did not say I admired Judge Pozon, all I said is I commend him for implementing the our Law as it should be.

This is a 21 year old US marine participating in the joint military exercise. They are governed by VFA agreement entered into by OUR representative – the justice secretary himself, and ratified by OUR own senate.
Article V, Paragraph 6 of the visiting forces agreement says “custody of any United States personnel over whom the Philippines is to exercise jurisdiction shall IMMEDIATELY reside with United States military authorities, if they so request, from the commission of the offense until completion of ALL judicial proceedings.”
We should not enter into an international agreement and later refuse to abide by its provisions when we realize that it does not serve our interest.

Regarding Article V Section 3,
“Recognizing the responsibility of the United States military authorities to maintain good order and discipline among its forces, Philippine authorities will, upon request by the United States, waive their primary right to exercise jurisdiction except in cases of particular importance to the Philippines. If the Government of the Philippines determines that the case is of particular importance, it shall communicate such determination to the United States authorities within twenty (20) days after the Philippine authorities receive the United States request.”
This is a prime example of the worst decision our goverment representative does. This clause puts American above our LAW.
This pretty much give any American Soldier or personnel that is participating in “MILITARY TRAINING” in the Philippines a license to kill, do what they want with any Filipino’s, with no fear of being prosecuted.
So I apologized, if I’m a little bit sensitive regarding this matter, cause if Smith did “know” about this Clause, then what stop him from doing what the alleged victim have claimed. All he would be expecting is a slap in the hand reprimand.
My opinion is all about supporting our judicial branch on whatever they have decided, politically motivated or not. The reason I commended Judge Pozon is because he put a pressure to our Appealate Court and Supreme Court to get on their lazy fat a_ _ out of the bench and get working on giving a meaning to the clause that our loving representative have signed.
But what can we do we elected those F__kers! pardon my language….
To conclude the whole Smith case… it will be overturned, Smith will be back in the US with his family as a freeman. Media gets another huge expose! And everybody forget about the whole thing….

I too don’t feel the sentence (40 years) is fair. For some reason when I watched the news when he was sentenced (eventhough I did not follow the case) something inside me just felt sorry and knew right away something is wrong.
And just for the record, I did not even know which of the four is Smith… for some reason I was thinking it was the black american marine.
Anyhow, I always trust my intuitions and I really hope and pray that Smith will reunite with his family. In my opinion, his verdict is influenced by media and politcal reasons… that’s only my opinion…

Nicole Is the Victim of rape.. The Rapist name… is Daniel Smith… If this rape had taken place in any other country the Victim of the rape would be the one that gets supported..

The Evidence presented in the court.. by 23 witnessed was overwhelmingly against Smith… He was found Guilty and is now a Convicted Rapist.
The sympathy i feel is for the Victim.. not the Rapist.

I worked in a marine base for 7 months. Everyone was friendly, warm, accomodating, safe & considerate. Regardless of their ranks, their physical appearances, and the like, when they approach me, you’d see the respect & friendly ambience around them. I don’t understand why they kept saying Mr. Daniel Smith raped Nicole, then all the evidences were not even accurate.
